AERODYNE GLOBAL LTD – WARRANTY TERMS AND CONDITIONS

These warranty terms and conditions (“Warranty”) apply to all products (“Products”) supplied by Aerodyne Global Ltd, company registration number 09535922 whose registered office is at 1 The Forum, Minerva Business Park, Lynch Wood, Peterborough, Cambridgeshire, England, PE2 6FT (“Aerodyne/ We/ Us/ Our/s”) to its customers (“Customer/You/Your/s”). The Warranty terms are incorporated into Our contract with You to the exclusion of any terms that You may purport to incorporate or any warranty terms that are implied by law. No variation to this Warranty will be accepted unless We agree in writing.

1. What is covered?

We will rectify defects affecting the Products which are clearly attributable to material or manufacturing faults, provided they are reported within 48 hours of being identified, and within 12 months of the date of delivery (the “Warranty Period”).

Please note that any rectifications undertaken by Us pursuant to this warranty neither extend the term of the Warranty nor set in motion a new warranty period.

We warrant that the Goods shall, for the Warranty Period:

• conform in all material respects to the Order and Specification;
• be free from material defects in design, material and workmanship; and
• be of satisfactory quality within the meaning of the Sale of Goods Act 1979.

2. What will Aerodyne do?

Following receipt of proof of purchase, and subject to Us being satisfied that the claim is valid, We will rectify the defects covered by this Warranty. Such rectification shall be free of charge and we will decide in our absolute discretion whether this will take the form of a repair or replacement or We may refund the purchase cost of the Products.

3. How can I make a warranty claim?

All claims under this warranty must be made in writing within 48 hours of the defect being identified and sent by email to warranty@aerodyneuk.com

It is a condition of this warranty that You must submit a detailed warranty claim form which includes the following:

a) a detailed description of the alleged defect;
b) the cause of the alleged defect; and
c) evidence of the alleged defect including photographs where appropriate

We will usually require You to return the Products to Our premises before We will consider Your warranty claim.

For Vehicles registered in the UK our premises are located at Innovation House, Tunnel Bank, Bourne, Lincolnshire PE10 0DJ

Where we ask You to You must also:

• Provide Us with access to the property on which the Products are situated and allow Us to inspect and repair (where relevant) the Products and any defective parts at a mutually convenient time;
• Allow Us to repair the Product at the premises where the Product is located;
• Allow Us to take and remove the Products which are the subject of the warranty claim to allow for further investigation and testing;
• Move the Product, the subject of the warranty claim, to and/or from a mutually agreed repair facility, at Your cost.
• Demonstrate that You have followed Our instructions regarding fitting of the Products; and
• Cooperate with Our reasonable requests.

If You do not comply with any of the above, We reserve the right to treat Your warranty claim as invalid.

4. What is excluded?

  • No liability under this Warranty will be accepted for the following:
  •  variances from nominal features which are of no significance to the Products’ value or fitness for purpose;
    accidental damage to the Products caused after the Products have been delivered to You;
  •  minor colour variances to the Product within normal industry tolerances;
  • UV ray damage;
  • colour fading;
  • damage to the Product due to chemicals used by You or Your agents such as traffic film remover and detergents.
  • improper use or installation;
  • use or installation not in accordance with Our instructions;
  •  improper or inadequate maintenance;
  •  unauthorised use, modification or alteration;
  •  neglect, misuse or abuse of the Products;
  •  normal wear and tear;
  •  wear and tear caused by multiple installations and dismantling;
  •  incorrect storage or handling by You or any third party on acting on Your behalf;
  •  failure of support components supplied by third parties;
  •  exposure to corrosive elements or incompatible products;
  •  items or goods connected to, on, inside or near the Products;
  •  vandalism or intentional damage whether by You or a third party;
  •  war, revolution, terrorism, riot or civil commotion, explosion, fire, corrosion, ionising radiation, radioactive contamination, natural disaster, or adverse or extreme weather conditions;
  •  issues relating to vehicle design changes by the original vehicle manufacturer which We were not notified about in writing;
  • damage caused by a third party engaged by You, or on Your behalf, to fit and install the Products;

• Products that have been repaired or modified by any third party before, where such repairs or modifications were not authorised by Us;
• the costs of hiring a replacement vehicle or any other associated costs if the vehicle to which the Products is fitted is taken off the road.
• Disposal costs of replaced or scrapped Products

Please note that We shall not be required to carry out any rectifications under this warranty if You are in default of any arrangements with Us in relation to any Products which are the subject of a warranty claim.

In no event shall We or any of Our agents be liable for any direct, indirect or consequential damages, including loss of profits. By accepting the benefit of this warranty, You release and discharge Us and Our agents from any further claim, action or demand arising from any defect covered by this warranty.

In the case of a warranty claim not being proven to Our satisfaction or it being determined that the claim falls outside the terms of this warranty, You shall pay Our reasonable expenses or those of Our representative, including the costs of visiting the location where the Products are, inspecting, investigating and reporting on the claim.

5. Governing law and jurisdiction
Any dispute or claim arising out of or in connection with this Warranty, their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with these terms and conditions or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.
